We, Nayse Vaiaoga (“FreshyMoji”), provide a service on which applications are offered to users. This Privacy Policy (the "Privacy Policy") describes the privacy practices that we employ with regard to information we collect, use, and share in relation to our mobile services and software provided on or in connection with any applications (collectively, the “Service”), and with respect to the user’s (“You,” “Your,” or “User”) choices about the collection and use of your information.

2. Data Collected by FreshyMoji
Personally Identifiable Information
When you use the Service, we do not collect personally identifiable information about you such as emails, or social media account names or handles.

3. Location Data
We do not use, collect or track your precise geographic location, but may collect your city location for general research and marketing purposes.

4. Device-Specific Information
Device-specific information is collected automatically when you use the Service, and includes the following information about a User's device: the unique device ID assigned to your phone on iOS, platform type and version (iOS v4, etc.), hardware and processor type, screen resolution and human readable hardware name. FreshyMoji uses this information to select appropriate art for the screen resolution, and to determine the hardware requirements of the Service’s user base.

5. Modified Content
All artwork, assets, and design elements contained in the Service contain copyrighted content or proprietary content owned or controlled by FreshyMoji or an affiliated company, brand or artist (“Original Content”). Subject to the User’s consent for FreshyMoji and our Affiliates and/or Business Partners for use of content submitted to the Service, the User retains his or her rights to any content owned by the User and submitted to the Service in connection with use of the service (“Submitted Content”). All user-created content which makes use of Original Content (which may include, without limitation, a combination of Submitted Content and Original Content) (“Modified Content”), is fully licensed to FreshyMoji and/or affiliated brands, artists, Business Partners and/or Affiliates irrevocably for all uses, known and unknown, in perpetuity, throughout the universe. This means that FreshyMoji has your permission to use and share Modified Content for the purpose of offering the Service, marketing and promotional purposes, and even to sell. 6. Data Retained After Deletion of Application
Following deletion of the FreshyMoji Application, FreshyMoji or our Affiliates and/or Business Partners may retain user information collected, including Submitted Content and Modified Content, for any use set forth in this Privacy Policy.

7. Sale or Change of Control of FreshyMoji
If we sell or otherwise transfer part or the whole of FeshyMoji or our assets to another organization (for example, in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your Submitted Content, Modified Content and any other information collected through the Service may be among the items sold or transferred. You will continue to own your Submitted Content as provided herein. The buyer or transferee will be expected to honor the commitments we have made in this Privacy Policy.

8. Modifications to the Privacy Policy
FreshyMoji may modify the Privacy Policy when FeshyMoji deems necessary, without providing prior notice to Users other than posting the Privacy Policy on the FeshyMoji website. Modifications will become effective once the modified Privacy Policy is posted on an appropriate location within the website operated by FeshyMoji or in the Application through which the User accesses the Service. Users shall be deemed to have granted valid and irrevocable consent to any modified Privacy Policy by continuing to use the Service. Users shall refer to the Privacy Policy on a regular basis when using the Service, since a separate notification regarding the modification to the Privacy may not be provided.
